With effect from 15/06/2021, hundertzehn GmbH ("hundertzehn") has updated its privacy policy ("Policy").
1. Introduction
This Policy describes our commitment to protecting the privacy of people who visit our MOCO service and its website ("Website Visitors"), who register to use the products and services ("Service") for which we offer subscriptions (available at www.mocoapp.com). For the purposes of this Policy, the term "Websites" collectively refers to *.mocoapp.com.
2. Scope of This Policy
In addition to the Websites linked to this Policy, this Policy applies to the following:

In this Policy, personal information means information relating to an identified or identifiable natural person. An identifiable person is someone who can be identified, directly or indirectly, in particular by reference to a name, an identification number, location data and online identifiers, or other data that allows unique identification.
The use of information collected through our Service is limited to the purpose of providing the Service for which subscribers have signed up.
Our Websites may contain links to other websites. These are subject to the privacy policies of the respective operators/controllers. We recommend that you read the privacy policies of those other websites to understand how they handle your data.
Account information (as defined below) and other information we collect in connection with your registration or authentication for our services (as defined below) are covered by this Policy. Our security and privacy practices, including how we handle electronic data, text, messages, communications, or other materials transmitted to and stored for you ("Service Data"), are described in this privacy policy.
If a subscription agreement or other applicable agreement/contract between you or your employer, or a contracting party ("Principal/Client"), and a member of the hundertzehn group has been agreed in relation to your access to and use of a particular service, such as MOCO (together referred to as the "Service Agreement"), that Service Agreement applies. In addition, the applicable data processing agreement between hundertzehn and the Principal applies.
3. Data You Provide to Us
Account and Registration Information
To provide the Service, we store information about you, such as your name, address, telephone number, and email address. For the purposes of this Policy, we refer to all information described above as "Account Information". By voluntarily providing us with your Account Information, you confirm that you are the owner of this personal data or otherwise have the necessary consent to provide it to us.
Other Data
We ask you for personal data when you submit web forms on our Websites or when you use interactive features of the Websites, including customer support enquiries or other communications with us.
Mobile Applications
When you download and use our services, we automatically collect information about the type of device used and the operating system version. The following data is collected by our Apps (in addition to "Account Information"):

4. Information We Collect from You
Cookies, Tracking, and Analytics Technologies
We may use cookies and other data collection technologies. These technologies may provide us with personal information, information about the devices and networks you use to access our Websites, and other information about your interactions with our Websites. When using such technologies, we will inform you directly, and, depending on the case, you will have the option to enable or disable these services (opt-in).
Logs
As with most websites and services delivered over the internet, we collect certain information and store it in log files when you interact with our Websites and services. This information includes IP addresses (Internet Protocol), browser type, internet service provider, referring/exit page URLs, operating system, date/time stamps, information searched for, locale and language settings, and identification numbers associated with your devices, information about your mobile network provider, and system configuration.
Social Media
Our Websites provide a link to social media websites such as Facebook or Twitter. We do not use social media plugins. Your interactions with these features are governed by the privacy policies of the companies that provide them.
5. How We Use the Information We Collect
General Use
We may use the information we collect about you (including personal data) for the following purposes:
- (a) providing, operating, maintaining, improving, and promoting the services;
- (b) enabling you to access and use the services;
- (c) processing and completing transactions and sending related information, including purchase confirmations and invoices;
- (d) sending transactional messages, including responses to your comments, questions, and requests;
- (e) customer service and support; providing technical notices, updates, security alerts, and support and administrative messages. (e) offering competitions;
- (f) monitoring and analysing trends, usage, and activities in connection with our services;
- (g) investigating and preventing fraudulent transactions, preventing unauthorised access to our services, and preventing other illegal activities; and
- (h) for other purposes for which we obtain your consent.
If we send you promotional communications, such as information about products and services, features, surveys, newsletters, quotes, promotions, competitions, and events, and other news or information about us and our partners, we will ask for your explicit consent in advance (double opt-in or a similar method). You can opt out of receiving marketing communications from us at any time by contacting us at privacy@mocoapp.com or by following the unsubscribe instructions in our marketing communications.
Legal Basis for Processing
We only collect personal data from you if
- (a) you have given your consent,
- (b) we need the personal information to enter into or perform a contract with you (e.g. to provide the hundertzehn services you requested), or
- (c) there is a legitimate interest in the processing. In some cases, we may be legally required to collect personal data from you.
Where we rely on your consent to process personal data, you have the right to withdraw or refuse your consent at any time. Please note that this does not affect the lawfulness of processing before your withdrawal. This applies in particular to the processing of your data during the trial subscription. Data collected as part of trial subscriptions will be deleted no later than 60 days after the end of the trial subscription. If we ask you to provide personal data to comply with legal requirements or to perform a contract with you, we will make this clear at the relevant time, and we will inform you whether providing your personal data is mandatory, as well as the possible consequences if you do not provide it. 6. Data Sharing
Data sharing with third parties in the context of MOCO: The following subprocessors are involved in providing the services:
Website (www.mocoapp.com)
- (a) Google reCaptcha (USA, processing on our behalf in accordance with Art. 28 GDPR). Google reCaptcha determines whether a human or a computer is making entries in our contact or sign-up form. Google collects the IP address, the webpage on which the captcha is embedded at www.mocoapp.com, the date, the duration of the visit, the browser and operating system type used, your Google account if you are logged in to Google, mouse movements on the reCaptcha areas, and tasks where you have to identify images. This processing is necessary to prevent spam and is used on the "Contact" and "Create Account" pages.
- (b) Intercom (USA, processing on our behalf in accordance with Art. 28 GDPR). Intercom records emails submitted via our contact form (first name, last name, email address, read status), enabling the operator of MOCO to provide users with the best possible and personalised support. If inactive, the data is deleted after 60 days (opt-in via the contact form or by creating a trial account).
- (c) Exoscale (CH): European provider for operating the MOCO website in a Swiss data centre.
- (d) Google Tag Manager* (USA): managing website tags through an interface.
- (e) Google Analytics* (USA): analysis of website usage (IP anonymisation enabled).
- (f) HubSpot** (USA): marketing automation and CRM (IP address, date, time, page accessed, browser information, clicks on elements).
- (g) Meta Pixel*** (USA): marketing automation and CRM (IP address, date, time, page accessed, browser information, clicks on elements).
- (h) LinkedIn Insight Tag**** (USA): marketing automation and CRM (IP address, date, time, page accessed, browser information, clicks on elements).
Google Tag Manager*
We use the Google Tag Manager service. The Tag Manager allows us to manage other tracking and marketing tools (e.g. Meta Pixel) without creating user profiles ourselves. The Tag Manager itself does not store user profiles according to current knowledge and does not access the data collected via the tags, but it can process your IP address and technical information (e.g. browser, operating system, time of access) that is transmitted to Google servers. The use of Google Tag Manager is based on your consent in accordance with Art. 6(1)(a) GDPR in conjunction with the relevant provisions of the TDDDG; you can revoke your consent at any time with effect for the future via our consent management (cookie banner). If data is transferred to the USA in this context, we point out that this is based on appropriate safeguards within the meaning of Arts. 44 et seq. GDPR; further information can be found in Google's privacy policy.
Google Analytics*
This website uses the "Google Analytics" service, provided by Google LLC (USA), to analyse how users use the website. The service uses "cookies"—text files stored on your device. The information collected by the cookies is generally sent to a Google server in the USA and stored there.
IP anonymisation is used on this website. Users' IP addresses are shortened within the member states of the EU and the European Economic Area. This shortening removes the direct personal reference of your IP address. Under the data processing agreement that the website operators have concluded with Google LLC, Google uses the information collected to evaluate website use and website activity, and to provide services related to internet usage.
You can prevent cookies from being stored on your device by adjusting your browser settings accordingly. It cannot be guaranteed that you will be able to access all functions of this website without restrictions if your browser does not allow cookies.

HubSpot**
When you visit this website, personal data is processed. Categories of data processed: technical connection data from server access (IP address, date, time, page accessed, browser information, login details for the trial subscription) and data about the use of the website, as well as the logging of clicks on individual elements. Purpose of processing: anonymisation and creation of statistics, analysis of user behaviour, and optimisation of content. Legal basis for processing: your consent under Art. 6(1)(a) GDPR. Data is transferred to the processor HubSpot, Inc., Two Canal Park, Cambridge, MA 02141-1814, USA (https://www.hubspot.com). This may also involve transferring personal data to a country outside the European Union. The transfer of data to the USA is based on Art. 45 GDPR in conjunction with the European Commission adequacy decision C(2023) 4745, as the data recipient has committed to complying with the data processing principles of the Data Privacy Framework (DPF).
Meta***
To analyse and optimise our advertising on Facebook and Instagram, we use the Meta Pixel, a service provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin, Ireland. The Meta Pixel enables us to track user behaviour after they click on a Facebook or Instagram advert. The data is processed on the basis of your consent in accordance with Art. 6 para. The data collected, such as user behaviour, IP address, and browser data, is transferred to Meta servers in the USA. The transfer is carried out in compliance with the European Commission’s Standard Contractual Clauses. The retention period is 180 days. Further information can be found in Meta’s privacy policy.
LinkedIn****
We use the LinkedIn Insight Tag, a service provided by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland, to obtain information about the use of our website and to optimise our advertising on LinkedIn. The data is processed on the basis of your consent in accordance with Art. 6(1)(a) GDPR. The data collected, such as IP address, browser information, and referrer URL, is transferred to LinkedIn servers in the USA. The transfer is carried out in compliance with the European Commission’s Standard Contractual Clauses. The retention period is 180 days. Further information can be found in LinkedIn’s privacy policy.

Compliance with Laws and Law Enforcement Requests; Protection of Our Rights
In certain situations, we may need to disclose personal data in response to lawful requests by public authorities, including to meet law enforcement requirements or court orders. We may disclose personal information to respond to subpoenas, court orders, or legal processes, or to establish or exercise our legal rights, or to defend legal claims. We may also share this information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, breaches of our Service Agreement, or otherwise.
7. Data Storage
hundertzehn is a company based in Switzerland. We store personal information about Website Visitors and subscribers in Switzerland.
8. Your Rights
The security of your personal data is important to us. We comply with Swiss data protection law and take EU GDPR standards into account in order to protect the personal data you provide to us. If you have any questions about the security of your personal data, you can contact us at privacy@mocoapp.com.
Data protection rights primarily apply vis-à-vis your contracting party (the controller of your personal data). If you are a MOCO end user, please contact the contracting party who set up your MOCO access first.
Upon request, we will inform you whether we hold or process personal data about you. To request this information, please contact us at privacy@mocoapp.com. In addition, you have the following rights:
You can manage your receipt of marketing and non-transactional communications by clicking the "Unsubscribe" link at the bottom of our marketing emails, or you can send a request to privacy@mocoapp.com.
Right to Erasure
You have the right to have personal data we hold about you deleted—for example, if it is no longer necessary for the purposes for which it was originally collected. Please note, however, that we may need to retain certain information for logging purposes in order to complete transactions or comply with our legal obligations.
Right to Object
You have the right to request that hundertzehn stops processing your personal data and/or no longer sends you marketing communications.
Right to Rectification and Restriction
You have the right to request that we restrict the processing of your personal data in certain circumstances (e.g. if you believe the personal data we hold is inaccurate or unlawful). You have the right to have clearly incorrect data corrected.
Right to Data Portability
In certain circumstances, you may have the right to receive your personal data in a commonly used format and to request that we transfer the personal data to another controller without hindrance.
How Long We Keep Your Personal Information
We will retain your personal data for as long as necessary to fulfil the purposes described in this privacy policy, unless a longer retention period is required or permitted by law (e.g. tax, accounting, or other legal requirements). If we have no legitimate business need to process your personal data, we will delete it. If this is not possible (for example, because your personal information is stored in backup archives), we will securely store your personal data and isolate it from any further processing until deletion is possible.
To request that personal information we maintain is returned to you or removed, please email us. Requests for access to, changes to, or deletion of your data will be processed within thirty (30) days.
If you wish to exercise these rights, please contact us using the contact details in section 11 below. We will review your request in accordance with applicable laws. To protect your privacy and security, we may take steps to verify your identity before fulfilling the request.
9. Personal Information of Children
We do not knowingly collect personal information from children. We encourage parents and guardians to monitor their children’s internet use and to help enforce this Policy by instructing their children never to provide personal information via the Websites or services without permission. If you have reason to believe that a child under 16 has provided us with personal data via the Websites or services, please contact us at privacy@mocoapp.com, and we will make reasonable efforts to delete this information.
10. Special Categories of Personal Data
You must ensure that no data under Art. 9 GDPR is collected. This includes the following categories of data:
- racial and ethnic origin
- political opinions
- religious or philosophical beliefs
- trade union membership
- genetic data
- biometric data for the unique identification of a natural person
- health data
- data concerning a person’s sex life or sexual orientation
11. Changes to This Policy
If there are material changes to this Policy, you will be notified before the change takes effect by publishing a notice on the Websites. Depending on the severity and impact on your personal rights, your consent may be required for certain changes. In that case, we will notify you and ask for your consent.
For minor changes that do not affect your privacy, we will announce the changes on the Websites. We recommend that you check this page regularly for up-to-date information about our privacy practices. Your continued use of the Websites or the services constitutes your consent to be bound by such changes to this Policy. If you do not accept the terms of this Policy, your only option is to stop using the Websites and the services.
